Gina Lynn Lemert, 57, of Mankato was convicted of traffic-DWI-operate motor vehicle-alcohol concentration 0.08 within 2 hours; fined $810. Sentenced to adult supervised probation, 2 years, local confinement 364 days, 363 days for 2 years credit for time served, 1 day, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, do not use or possess firearms, ammunition or explosives, do not inter bars or liquor stores. The charge of traffic-DWI-Operate motor vehicle under influence of alcohol was dismissed.

Sentenced to jail 90 days, stay 90 days for 1 year, unsupervised probation, 1 year, no same or similar, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing as directed by probation, law enforcement or designee at any time to verify compliance with the abstinence requirement, attend MADD Impact Panel, complete and pay for within 6 month of sentencing and provide roof to probation agent.
