FAIRMONT - A Fairmont man and woman face charges of gross misdemeanor domestic assault after allegedly assaulting each other.
According to information from the Fairmont Police Department:
Shortly before 5 p.m. July 1, Fairmont police responded to the report of a domestic assault. Police went to an apartment and found a man and woman arguing.
They were identified as O'Daniel Bland Jr., 49, and Diana Lynn Buehler, 44. The couple had lived together, but separated.
Police noted the couple were in Bland's apartment, and there was a TV that was knocked to the floor.
Buehler reported they had been arguing when Bland walked away from her, and she pushed the TV to the floor. While the TV was in Bland's apartment, Buehler said it was her TV. Bland then grabbed Buehler by the neck, pushed her onto the couch and hit her in the head, according to Buehler's statement. Police saw marks on Buehler's neck.
Bland told police Buehler had come over and wanted him to ask someone for money for her. When he refused, Buehler "flipped out" and pushed the TV and hit him with it, and then came after him and attempted to stab him in the eye. Bland's eye was red and he had blood on the outside of his face, and there was a poke mark near the inside of his eye.
When Buehler was questioned about attempting to stab Bland in the eye, she said she may have poked him with her fingernails.
Police had cleared the scene, but were called back to the apartment later in the evening. Police saw a broken chair and Buehler screaming at Bland, and she was claiming he had her food. Bland said Buehler had crashed through a screen door to enter the apartment, and Buehler said Bland pushed her into a chair, causing it to break, and that she hit her head. Police observed a small bump on Buehler's head.
Both Buehler and Bland were placed under arrest and Buehler became belligerent.
A background check showed Bland was convicted of terroristic threats in 2005, and Buehler was convicted of violating a harassment restraining order in 2012.
Both face charges of gross misdemeanor domestic assault; maximum penalty of a year in jail and a $3,000 fine, and a misdemeanor count of disorderly conduct; maximum penalty of 90 days in jail and a $1,000 fine.
