Stallkamp still facing charges

BLUE EARTH - A judge has rejected a motion to dismiss criminal charges against a Bricelyn man in a case involving the accidental shooting of a teenager.

Daniel Craig Stallkamp, 20, of Bricelyn was charged in September following the accidental shooting of Collin Jacobson, also of Bricelyn, in July 2008. Stallkamp is charged with possession of an assault weapon and contributing to the delinquency of a minor.

Stallkamp's public defender, Troy Timmerman, argued that because Jacobson was a juvenile, he technically could not have committed the crime to which Stallkamp allegedly contributed. Timmerman offered a similar argument against the illegal possession charge.

Faribault County Attorney Brian Roverud argued state law includes an act committed by a juvenile "that would be a crime if committed by an adult." He said juveniles may not possess a pistol under age 18 unless under the actual presence of a parent or guardian.

Roverud accused Timmerman of trying to narrow the scope of prosecutions by using a law that was intended to expand the scope.

Judge Douglas Richards recently filed his ruling: "It is fair and reasonable, given the facts disclosed by the record, to require ... Stallkamp to stand trial on the charges of aiding/abetting unlawful possession of pistol in violation of (state statute)."
