Attorney: Drop 2 of 4 charges

BLUE EARTH - The attorney for a man accused of holding a woman against her will in his trailer has asked that some of the charges against his client be dropped.

Public defender William Grogin also is seeking a bail reduction for Warren James Allen, 65, of Winnebago.

Allen was arrested on Nov. 21 after a neighbor called police about a woman who needed medical attention being held against her will.

On Monday, Grogin asked Judge Douglas Richards to drop two of four charges.

Allen is charged with kidnapping, terroristic threats, domestic assault and false imprisonment. Grogin contested the false imprisonment and kidnapping charges.

"Our position is if the front door was locked, the other door was not," Grogin explained. "For further support, she could call a friend several times without issue."

Faribault County Attorney Brian Roverud justified the charges by referring to the criminal complaint. It states the alleged victim said Allen would not allow her to leave at any time, under threat of great harm.

Roverud asked Richards to allow him one week to get all of the necessary transcribed statements. Richards granted Roverud's request.

Grogin again asked the court to reduce Allen's bail. It is set at $200,000 with conditions, $100,000 without.

"Mr. Allen cannot possibly come up with that," Grogin said, adding that Allen has always been faithful in attending court hearings for past charges. Allen has prior convictions for domestic assault, assaulting police, bank robbery and violating orders of protection.

Roverud advised against reducing bail, citing a public safety risk.

"Mr. Allen's behavior while on release for other files has been a risk to the community," he said.

Grogin asked that a bail study be completed.

Allen then asked to address the court. He noted that two weeks ago, he requested a bail study that was to be completed by Monday. Richards looked through the file and found no bail study.

Allen will appear in court Dec. 21 for a continued hearing at which bail will again be addressed.
