Suit may not make it to court
Jenn Brookens — Staff WriterFAIRMONT - A lawsuit filed against two Fairmont police officers could be headed for dismissal upon further investigation.
The suit claims Kai Martin White, 35, of Truman, was assaulted by officers Bryan Boltjes and Brad Buhmann. The suit also originally named Martin County Sheriff's Office Capt. Jeff Markquart. However, Markquart and the sheriff's office were later dropped from the defendant's list.
The case alleges that White had been drinking at Green Mill on June 30, 2008. He became intoxicated and staff at the lounge asked him to leave. When he refused, police were called.
According to the original complaint, White remembers at one point being hit with a hard object, seeing a white flash and being knocked unconscious. He also suffered injuries to his jaw and had lacerations and bruising as a result.
Markquart gave a formal statement included in the case file, which states he assisted the two Fairmont officers at the scene and by escorting White to the holding cell in the jail. His statement claims White was uncooperative and intoxicated, but he did not show any signs of injury, nor did he complain of being assaulted.
According to Martin County Attorney Terry Viesselman, White was transported to Watonwan County for an unrelated case shortly after his arrest.
"All of our investigations show that (White) was not suffering from any injuries from the time he was arrested to when he was taken to Watonwan County," Viesselman said.
White's attorney, T. Oliver Skillings of North Mankato, confirmed he may drop the entire action after more investigation, but he declined to comment any further.
The next hearing in the case is scheduled for Nov. 17.
